Ross Pearlson, co-chair of Wolff & Samson’s Litigation Group, is an accomplished litigator with 25 years of experience in civil and criminal investigations and prosecutions. His experience includes a wide range of white collar criminal cases and investigations, as well as complex commercial litigation, with an emphasis on health care and securities matters.
From 1990 to 1994, Ross served as an Assistant United States Attorney in the Eastern District of New York, prosecuting federal felony cases involving such high-profile issues as mail, wire and securities fraud, and RICO violations, among others. His success in this role earned him the Director’s Award from Attorney General Janet Reno for Sustained Superior Performance as an Assistant United States Attorney.
Ross has successfully represented corporations and individuals in criminal investigations brought by the United States Attorney’s Office, the Securities and Exchange Commission and the Attorney General’s Offices for the States of New York and New Jersey. His clients range from major international conglomerates and domestic corporations to securities firms, broker-dealers, and health care businesses and providers. Ross has also been retained by several Fortune 500 companies to conduct internal investigations into allegations of misconduct.
In addition, Ross regularly handles such diverse matters as restrictive covenant, unfair competition and other commercial torts and contract disputes, consumer fraud, and securities and other class action litigation. His courtroom experience includes extensive motion practice and hearings and numerous civil and criminal trials and arbitrations.
Recently, Ross prevailed at trial on fraudulent conveyance claims asserted against his client, a hedge fund, and also obtained the dismissal of three separate lawsuits brought against his health care clients under the Insurance Fraud Prevention Act. His experience in civil litigation also includes:
- the successful defense of a major international corporation in a $110 million lawsuit;
- two shareholder oppression actions in which he persuaded the respective courts to grant summary judgment on behalf of his clients;
- the recovery of millions of dollars in multiple litigations brought on behalf of the Chapter 11 Trustee of a broker-dealer involved in a $100 million Ponzi scheme;
- the successful defense of a client in an international arbitration involving a $17 million dispute over a line of diagnostic blood tests;
- obtaining a grant of summary judgment on behalf of a Fortune 500 company in a lawsuit involving misrepresentations made by a competitor on its website; and
- the successful representation of a major investment bank in connection with litigation over a piece of property purchased for the development of a $2 billion casino.
Prior to joining Wolff & Samson, Ross was a member of Sills Cummis & Gross PC, where he focused on corporate internal investigations, white collar crime and litigation.
Ross was selected for inclusion in the 2012 edition of New Jersey Super Lawyers.
Ross received his B.A., with high distinction, from Wesleyan University and his J.D., cum laude, from Harvard Law School.
