Daniel T. McKillop is a litigator and regulatory attorney in Wolff & Samson’s Environmental Group. Dan represents corporate, developer and individual clients in litigations before administrative, state and federal courts involving numerous environmental statutes, including the federal Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), Resource Conservation and Recovery Act (RCRA), New Jersey Spill Compensation and Control Act, Industrial Site Recovery Act (ISRA) and Site Remediation Reform Act (SRRA). Dan also represents and advises national insurance carriers in complex, multi-party environmental remediation litigations, the most recent of which were venued in the Northern District of Illinois and the Central District Court of California. In addition to litigating on behalf of clients, Dan also provides counsel with respect to environmental regulatory issues, including the environmental aspects of commercial real estate sales and acquisitions, compliance with industrial air emissions standards and environmental permitting required for commercial and private development projects.
Dan also speaks at conferences and continuing legal education programs about environmental topics, and his previous presentation topics include the New Jersey Department of Environmental Protection's tidelands program and environmental site audits and self-assessments. Dan has also contributed to several environmental publications, including Environment, Energy, and Resources Law: The Year in Review 2009, published by the American Bar Association in March 2010, and he is currently revising several chapters of the upcoming third edition of New Jersey Environmental Law by Juris Publishing. Dan also previously co-authored “Un-Natural Resource Damages: NJDEP Goes Too Far Afield,” published in The Metropolitan Corporate Counsel.
Dan graduated cum laude from Pace University School of Law, where he earned his J.D. as well as certificates in both Environmental Law and International Law. During law school, Dan worked in the Office of the Staff Judge Advocate General (JAG) at the United States Military Academy at West Point and practiced law as a student attorney in the Pace Environmental Litigation Clinic. Dan was also a member of the Environmental Law Review, chaired the 2001 National Environmental Moot Court Competition hosted by Pace University, led the university’s team in the 2001 International Environmental Moot Court Competition and authored “Trade and Environment: International Dispute Resolution,” published by the Journal of the Pace Center for Environmental Legal Studies. Dan earned his Bachelor's degree in Government and International Studies from the University of Notre Dame.
