David Dugan, counsel at Wolff & Samson, represents clients in a variety of commercial disputes involving intricate aspects of contract law, RICO, real estate, breach of restrictive covenants, trade secret litigation, legal malpractice, banking customer dispute arbitrations, insurance, personal injury defense and the New Jersey Minority Shareholders’ Act. He practices in both New Jersey and New York state and federal courts.

Some of David’s notable accomplishments include:

  • Securing a $2.5 million settlement from a client’s competitor who initially accused the client of stealing trade secrets in a federal lawsuit based on manufactured and fabricated evidence
  • Obtaining dismissal and sanctions in a federal lawsuit alleging violation of due process against a special fiscal agent appointed in twenty-year-old state court action
  • Securing a settlement from a global conglomerate of companies whose overseas subsidiaries misappropriated his client’s environmental technology
  • Grappling with complex constitutional issues concerning free speech in obtaining a permanent injunction in federal court against a client’s former employee who engaged in a campaign to destroy the company through making false statements and engaging in threatening conduct directed at the company, as well as its customers, auditors, lenders and other business associates
  • Obtaining summary judgment on a $10 million securities fraud claim brought against his client by multiple overseas investors
  • Obtaining a dismissal of jury tampering charges arising out of a high-profile civil workplace harassment case brought against his client and her company

While David’s diverse background enables him to take on a variety of commercial and other types of matters, his practice is concentrated in part on protecting his clients’ trade secrets and confidential information from misuse and exploitation, including engaging in preliminary injunctive relief proceedings and engaging in expedited discovery where necessary to preserve his client’s business.

Prior to joining Wolff & Samson, David practiced at Carter Ledyard & Milburn LLP on Wall Street and at the Sills Cummis law firm in Newark, N.J.

While attending Rutgers University School of Law, David was the managing editor of the Rutgers Law Review and won the G.A. Moore, Jr. Prize for Equal Opportunity Employment Law. He was also committee chair of the Moot Court Board and interned for Senior Judge Leonard I. Garth of the United States Court of Appeals for the Third Circuit and District Judge Alfred J. Lechner of the United States District Court for the District of New Jersey.

In 2010 and 2011, David was listed as a "Rising Star" in New Jersey Super Lawyers.
