Eric Levine practices in the field of commercial litigation at Wolff & Samson, focusing primarily on surety, fidelity and construction litigation. His clients include surety companies, insurance companies, contractors, and other corporate and individual clients. He advises on a wide variety of commercial disputes in the New Jersey and New York state and federal courts, both at the trial and appellate levels.
Eric’s extensive experience litigating complex commercial cases includes those involving contract disputes; construction defaults; surety and fidelity bond claims; takeover and termination claims; lien law rights; creditors’ rights in bankruptcy; construction trust fund, defect and delay claims; insurance coverage disputes; professional malpractice claims; fraud and bad faith claims; and indemnification, exoneration and subrogation claims. He routinely counsels clients on risk management and litigation avoidance, and represents clients in various ADR proceedings involving mediations and arbitrations in both state and federal courts.
Eric regularly achieves favorable results for the firm’s clients, including:
- Negotiation of a settlement involving a $23 million surety bond dispute that resulted in the client obtaining full collateralization for the multimillion-dollar bonded risk
- Recovery of $230,000 for a surety client, representing full reimbursement for losses that the client incurred under subdivision bonds
- Recovery of $400,000 for a client by enforcement of judgment against the judgment debtor through foreclosure and forced sale of the judgment debtor’s real property
- Obtaining a no liability verdict in favor of the client following a trial involving claims asserted under preliminary injunction bond
Eric actively participates in numerous bar association subcommittees and sections pertaining to litigation and surety and construction law. He moderated and presented at the June 2008 New Jersey ICLE Seminar, “Fidelity and Surety Law: The Basics and 2008 Update,” sponsored by the Fidelity and Surety Law Section of the New Jersey State Bar Association. He is the author of an October 2003 article in the Surety Claims Institute Newsletter discussing the Tri-State Employment Services, Inc. v. The Mountbatten Surety Company case.
Eric received his J.D. from Hofstra University School of Law where he was a staff editor of the Hofstra Law Review.
