Joseph Monaghan practices surety and fidelity law and construction law at Wolff & Samson. In private practice and in his five years as in-house counsel to one of the firm’s commercial surety clients, Joe has handled a wide variety of surety matters throughout the country. His experience includes litigating many complex surety cases, as well as litigating matters involving partnership disputes, theft of trade secrets and commercial lending disputes.
Joe’s reported decisions in the surety field include the following matters, all of which are frequently cited by courts and commentators:
- In re Modular Structures, Inc., 27 F.3d 72 (3d Cir. 1994)
- In re Alcon Demolition, Inc., 204 B.R. 440 (D.N.J. 1997)
- Eagle Fire Protection Corp. v. First Indemnity of America Ins. Co., 145 N.J. 345 (1996)
Joe co-authored the chapter, “Bond, Contractual, and Statutory Provisions and the General Agreement of Indemnity,” in the Bond Default Manual and the chapter, “The Surety’s Recourse Against its Principal and Indemnitors,” in Managing and Litigating the Complex Surety Case.
Joe received his J.D. from Rutgers School of Law where he served as an editor on the Rutgers Law Review and was a member of the school’s Moot Court Board.
