Joseph Tripodi, a member of Wolff & Samson’s Litigation Group, practices in the areas of complex commercial litigation and legal malpractice.

Joe represents individuals, closely held and public corporations, partnerships and law firms, primarily in shareholder, contract, business tort, restrictive covenant, legal malpractice and real estate litigation matters in state and federal courts and arbitrations.

On the plaintiff’s side, Joe recently secured substantial recoveries from nationally recognized companies in the waste disposal and paper packaging industries in cases involving breach of contract and fraud claims, and from an individual who fraudulently induced his client into investing in a failed real estate venture. Joe also recently obtained a preliminary injunction against the majority shareholders of a corporation who attempted to remove his client from her positions as an officer and director and completely freeze her out of the corporation.

On the defense side, Joe has successfully represented individuals, companies and law firms against malpractice, breach of contract, breach of fiduciary duty and other claims. Cases of note include:

  • Dismissal of a multi-million dollar claim against a law firm alleging improper fee-splitting and conspiring to assist a non-lawyer in the unauthorized practice of law.
  • Dismissal of a multi-million dollar claim by a former employee alleging that he was entitled to receive more than he had agreed to in his severance agreement.
  • Dismissal of a multi-million dollar claim against a law firm alleging malpractice, breach of fiduciary duty and conflict of interests in connection with its representation of general and limited partners in a shareholders’ dispute.
  • Dismissal of malpractice and conspiracy claims against an accountant in connection with a bookkeeper’s embezzlement of hundreds of thousands of dollars from a high-end automobile dealership.
  • Successful defense of an attorney in a matter where sanctions were sought for alleged discovery violations.

Joe also counsels clients, including many New Jersey and New York businesses, and provides strategic advice to solve complex business problems without having to resort to litigation.
