Lee Henig-Elona is a Wolff & Samson attorney who devotes her practice to environmental litigation, including toxic torts and products liability litigation before various federal and state courts. This has included defending mass tort claims by chemical plant neighbors allegedly exposed to phosphorus oxychloride, personal injury class actions arising from allegedly defective or mis-labeled products, and multiple party property damage claims brought by homeowners of contaminated property.

Lee handles matters that involve both federal and state environmental statutes, including the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), the Resource Conservation and Recovery Act (RCRA) and the New Jersey Spill Compensation and Control Act (Spill Act). Her environmental cases typically encompass a multitude of issues, including:

  • Soil and groundwater contamination
  • Landfill closure and remediation
  • Operation of resource recovery facilities
  • Natural resource damages
  • Exposure to chemicals in the workplace and other settings

In addition, Lee counsels both individual and corporate clients on issues related to environmental criminal law, environmental permitting, regulatory compliance and enforcement matters. She appears before federal, state and local regulatory agencies and the New Jersey Office of Administrative Law on such matters.

Lee is pursuing a cost recovery action against the federal government in the Court of Federal Claims and the District of New Jersey on behalf of property developers who purchased portions of the former Raritan Arsenal Army facility for mixed-use development. Lee represents numerous companies in the “Tierra Litigation” commenced by the New Jersey Department of Environmental Protection (NJDEP) against Occidental Chemical and Tierra Solutions involving the investigation and remediation of dioxin pollution in the Newark Bay Complex.

Lee’s product liability practice involves defense of manufacturers whose products are claimed to be defectively designed, manufactured or sold without adequate warnings. Her experience includes numerous cases involving pipe ruptures, machinery and equipment, medical devices and food products.

In the area of toxic torts, Lee’s practice includes the defense of claims by neighbors of chemical and coatings manufacturers, workplace exposures brought by independent contractors and claims regarding mold exposure.

Lee graduated cum laude from New York Law School and earned her undergraduate degree, cum laude, from Rutgers University. She has an AV® rating from Martindale-Hubbell, the highest ranking of both ethical standards and legal ability that Martindale awards.
