Todd Terhune represents a diverse base of Wolff & Samson clients, ranging from individuals and closely held businesses to Fortune 500 companies. His practice is focused on advising clients on environmental due diligence, ISRA compliance and other environmental regulatory compliance issues that arise in connection with real estate and business transactions, or as a result of regulatory action.
Todd also represents clients in commercial real estate transactions, including Brownfield redevelopment projects, and in remediation and permitting matters before the U.S. Environmental Protection Agency (EPA) and the New Jersey Department of Environmental Protection. While Todd’s practice is based in New Jersey, he has also advised clients with projects located in North America, Europe, Australia and Asia.
Todd’s experience in Brownfield matters includes the representation of:
- A Brownfield developer in the acquisition, remediation and sale of a 130-acre former chemical manufacturing facility in Burlington Township, N.J.
- A Brownfield developer in the acquisition and remediation of a 400-acre former munitions manufacturing facility in Cranbury, N.J.
- A Brownfield developer in the acquisition and remediation of a 30-acre industrial property in Elizabeth, N.J.
- A Brownfield developer in the acquisition and remediation of a former chemical manufacturing facility in Woodbridge, N.J.
- A Brownfield developer in the acquisition and remediation of a former industrial facility in New Brunswick, N.J.
- A developer in the acquisition and remediation of former industrial facilities covering four city blocks in Hoboken, N.J.
- An investment bank in the acquisition of a contaminated property for development of a data center in Somerset, N.J.

- A printing manufacturer in connection with the sale of its facility in Clifton, N.J.
- An oil company in connection with the cessation of operations and sale of property in Perth Amboy, N.J.
- A metal fabrication facility in connection with the sale of property in Bogota, N.J.
- A pharmaceutical manufacturer in connection with the sale of its business in West Orange, N.J.
Todd’s other experience includes:
- Representing a battery manufacturer in the settlement of an air emission Notice of Violation
- Representing a software company in a dispute with the IRS for alleged improper treatment of the valuation of contaminated property it owned
- Representing a wetland mitigation bank developer in connection with permitting and land use issues in Carlstadt, N.J.
- Representing an educational institution in connection with permitting and land use issues in Princeton, N.J.
Prior to becoming an attorney, Todd, a licensed Professional Engineer (P.E.) and Certified Hazardous Material Manager (CHMM), was an environmental engineering consultant for eight years. His practice as a consultant focused on environmental due diligence for commercial and industrial real estate and business transactions, soil and groundwater contamination assessment, environmental permitting, and landfill gas assessment and control. During law school, Todd worked on CERCLA (Superfund) cost-recovery cases as a law clerk for the EPA.
