BPU Proposes 15 Year SACP Schedule

On September 23, 2011, the Board of Public Utilities (the “Board” or “BPU”) issued an Order related to the Solar Alternative Compliance Payment (“SACP”) in New Jersey’s Renewable Portfolio Standard. The Order directed the BPU staff to publish a proposed 15 year SACP schedule for the purpose of receiving public stakeholder comment. The adoption of a 15 year SACP schedule is mandated by the Solar Energy Advancement and Fair Competition Act (“SEAFCA”). 

By way of background, in 2007, the Board, following a public stakeholder process, established an eight year SACP schedule. The 15 year SACP schedule proposed by the BPU staff maintains the previously established SACP schedule for the next five years through its completion. Thereafter, the new SACP schedule proposes an initial reduction of 20% in the SACP amount beginning in Energy Year 2017, followed by annual reductions that continue the average annual decline of approximately 2.54%. The proposed SACP schedule is set forth below.

This proposed schedule is intended to be a starting point for further discussions with the public. This schedule will be the subject of a public stakeholder process as required by SEAFCA. BPU staff has indicated that the process for public comment will be forthcoming.
